Burgess Disability Law handles federal court appeals on a contingent-fee basis. There are no upfront attorney fees.

If we win in the federal district court, the government generally must pay us our attorney fees under the Equal Access to Justice Act (EAJA).

If the claimant is found disabled upon remand from the federal district court, we may be entitled to attorney fees under 42 U.S.C. § 406(b), which allows attorneys to be paid up to 25% of the claimant's past-due benefits.

All fees are subject to approval by the U.S. District Court.

Claimants may be responsible for paying the filing fee.
